This Agreement will be construed and enforced in accordance with the laws of Jamaica without regard to its conflict of law principles.

1. We reserve the right to change these terms and conditions without notice by posting the changes to our Website.
2. We or you may terminate your account and remove your site from our database at any time for any reason.
3. The following types of sites are NOT allowed to participate in psoj.org: sites encouraging illegal activity or racism, sites providing instructions or discussions about performing illegal activities, sites that promote or utilize software or services designed to deliver unsolicited email, or any other sites we deem to be inappropriate.
4. You have read our copyright notice and terms and conditions and you agree to them.
5. We are not liable for damages, direct or consequential, resulting from your use of the service, any failure to provide service, suspension of service, or termination of service. We do not guarantee the availability of the service. You agree not to hold us responsible for data loss or interruption of service of any kind.
6. We retain ownership and all rights to psoj.org logos, trademarks, software, trade secrets, databases, reports, and Website.
7. If this agreement is terminated by us or by you for any reason, you agree to remove your content, logos and trademarks from all of our Websites and other items.

Please read the following Terms & Conditions carefully since they govern your use of the Private Sector Organisation of Jamaica website (www.psoj.org). From this point on, we will refer to the Private Sector Organisation of Jamaica as “The PSOJ” and its website as the "Website" in these Terms & Conditions.

The PSOJ maintains its website to provide its members and the public with information on the Organisation’s products and services, allow our clients to perform financial transactions and to facilitate communication. From time to time we may revise these terms and conditions without prior notice.

By accessing this site you indicate your acknowledgement and acceptance of these Terms and Conditions.

All information submitted to The PSOJ via this Website shall be and remain the property of The PSOJ. The PSOJ shall be free to use, for any legal purpose, any ideas, concepts, know-how or techniques contained in the information provided by users of this Website. We will use our best efforts to include accurate and up to date information on this Website, but we make no warranties or representations as to the accuracy of the information.

STATEMENT OF INFORMATION WE COLLECT at PSOJ.ORG

The PSOJ is committed to the highest level of security and privacy regarding the collection and use of on-line information. Membership information may be collected through the submission of member applications online and online signup transactions. It also summarises your right to have access to correct the information as necessary. Client Record and Membership Information

In the course of our business relationship with you, the membership information collected about you is held in a "member record." This information likely includes, at a minimum, your name, address and telephone number(s), type of business, e-mail address and telephone number. Depending on the type of service you request, additional membership information may be held in your client record.

Collecting, Holding, Using and Disclosing Membership Information

THE PSOJ may collect, hold and use the membership information in your member record as well as collect membership information from and disclose membership information to the third parties identified below, for the following purposes:

• Identifying you and ensuring the accuracy of information contained in your client record;
• Establishing and administering your account, determining, maintaining, recording and transaction information in your member record;
• Executing transactions with or through The PSOJ including transferring funds by electronic or other means;
• Verifying information previously given by you with any other organisation when necessary;
• Advising you of other similar PSOJ products, services or initiatives that may be of interest to you; and,
• For any other purpose you and The PSOJ may agree upon from time to time.

Consent

Your knowledge and consent to The PSOJ’s collection, use and disclosure of your membership information is important. We rely on your actions as indications of your consent to our existing and future member information practices:

• Your voluntary provision of personal information directly to The PSOJ or through your authorised personnel;
• Your express consent or acknowledgement contained within a written, verbal or electronic application process;
• Your consent solicited by The PSOJ for a specified purpose;
• Your receipt of this Privacy Policy, until you notify The PSOJ of a withdrawal of your consent; or
• Your consent given through your authorised representative such as a legal guardian, agent or holder of a power of attorney.

Subject to certain legal or contractual restrictions and reasonable notice, you may withdraw your consent at any time. Location of Your Client Record

Your client record, whether electronic or paper, is kept at the offices of The PSOJ in Kingston, Jamaica. Paper records forming part of your client record may also be kept in offsite storage. Your client record may be transferred to other locations for disaster recovery purposes.

Right to Access and Correct Your Membership Information

You are entitled to access, through a written request, the membership information contained in your client record. Limits on how long personal information is kept

The PSOJ will only retain your membership information as long as it is necessary, including updating the product or service or as required by law. When we destroy the information, we will use safeguards to prevent unauthorised parties from gaining access to the information during the process.

Safeguards for your personal information

The PSOJ maintains appropriate technical and organization safeguards to protect your membership information against loss, theft, unauthorised access, disclosure, copying, use or modification. Encryption

The PSOJ uses a 256 bit SSL encryption for all e-commerce transactions.

PSOJ Refund Policy

The PSOJ commits to refunding payments made for attendance to any of our functions in the event that the function is unavoidably cancelled.

Payments made in the form of subscriptions or other fees will also be reimbursed provided that a documented request is received by the PSOJ at least one month before the beginning of the subscription or membership period. Please note that 5% of the dollar amount paid will be deducted for transaction costs.

Request for reimbursement may be made by way of email, written letter or fax, and should be addressed to the “Chief Executive Officer, Private Sector Organisation of Jamaica, 39 Hope Road, Kingston 10, Jamaica, W.I.”. Requests for reimbursement should contain the following information: Full contact information of the proposed reimbursed, date of payment, amount paid, mode of payment, and Name of service paid for.

Entities or individuals that qualify for reimbursement, having paid electronically, will be refunded within 30 business days after a formal request of refund has been made. Payments made by cheque or any other non-electronic means will be refunded within 30 business days after a formal request for reimbursement is made and, receipt of bank account information is acknowledged by the PSOJ. All payments done by the PSOJ will be remitted electronically.
